BONO - Youth center of law initiatives under Donetsk State University

Center of practical education was created by faculty
and students of economy and law department of Donetsk National University
in 1999 as its structural subdivision. There are 15 internships and 8
juridical clinics (public consultations). Each clinic has its own specialization
(civil, family, labor law, etc.), and is headed by a professional faculty
of each sphere. Each faculty works with ten sophomore-senior students
who have to win the competition.
Students get practical advices from leading specialists who work in different
spheres (judges, prosecutors, attorneys, legal advisers, workers of Antimonopoly
committee, lawyers). More than 270 academic hours are scheduled for work
at clinics and internships.
Students who work at the Center of Practical education with other faculty
and practicing lawyers demonstrate effectiveness of their efforts: over
the period of 2000 year they consulted about 300 poor citizens on civil,
family, communal and labor laws. During the time of the Center's existence
there were about 1000 court cases. We also signed agreements about cooperation
with economy and law department of Donetsk regional council of trade unions.
Public consultations are also available there.
Juridical clinics of Donetsk set active cooperation with experienced Centers
of practical education all over the world: American Bar Association, Center
of "Problems of education development" at Belarussian University,
Polish Association of practical education (Warsaw), Institute of Law (St.Petersburg),
Pittsburgh University (USA). These connections help our students to share
experience and solve common problems together.
In May 2001 after the radio broadcast citizens of the entire Donetsk region
learnt about our activity. Junior and senior students who work on public
consultations in different spheres gave concrete advices to audience duriing
the program "Vashe pravo" (Your right) on TV channel "Region".
After the program staff of economy and law department received letters
from the audience with their feedback about the program. It only shows
that citizens trust us, lawyers, who are now beginning their professional
activity.

Since November 1, 2000 based on Anton Makarenko KIPC there
is a juridical clinic "Bona fidez" (Good will). To prepare students
to work at this clinic we taught special course "Juridical clinics".
This course covered such topics:
- practical education for future lawyers;
- organization and structure of practical program "Juridical clinic";
- preparation and writing of legal documents;
- informational supply of the clinic's work
Students had to receive credits at the end of the course. At the end of
classes students who had Excellent grades and had a desire to work became
a part of the clinic's staff. We offered students to determine topics
for their future work themselves.
Clinic worked these hours:
- Tuesday - 14.00 - 17.00 - consultations at Professional-Technical Schools
#9 and #46,
- Wednesday - 16.00. - 19.00 consultations at the college (room # 107),
- Thrusday - 14.00. - 17.00 consultations and lessons on practical law
at Professional-Technical School #46, #9 in Kiev.
Work of the clinic is described in such documents:

After IRF grant we purchased office equipment, connected to the Internet,
bought stationary and covered transport expenses.
We distributed information about the work of our clinic
in professional-technical schools through phoned telagrams and announcements,
we also advertised this clinic on TV, announced it in "Ukrinform",
prepared a cycle of programs on "Promin" radiowave. The clinic
provided Shevchenko district Social Services department with its assistance
in legal issues. People who needed advice on legal issues and came to
Social services department of Shvchenko district got qualified help. The
clinic has good informational base (through library and Internet), has
CD with legislative acts. We are also subscribed for the newspaper "Jurydychnyy
Visnyk Ukrainy", besides, we printed forms of the most "popular"
juridical documents. 33 students work at the clinic. 87 citizens were
consulted during the reporting period. Spheres of law: civil law - 35
people, administrative law - 10, registration of citizens - 7 people,
housing law - 7 people, family law - 10, and labor law - 8 people.
Students conducted 26 lessons on street law, 74 students of professional-technical
school received assistance from psychologists and faculty. Consultations
and other assistance were free of charge.

Juridical clinic "Ad Astra" works on base of law department
of Volyn state Lesya Ukrainka University. It was created with participation
of Volyn regional Bar association of Ukraine and financed by International
Renaissance foundation in 1999.
The goals and tasks of this clinic are:
o to introduce practical work of students into educational process ;
o to provide free juridical help to poor citizens, and families with many
children, people who suffered from Chernobyl catastraphy, people with
disabilities, participants of war and national movements, pensioneers,
refurgees, teengers, entrepreneurs
· We cover work of this clinic and problems of reformation in penitentiary
system in the newspaper "Ad Astra" and other mass media;
o to monitor how well rights and freedoms are fulfilled in prisons, situated
in Volyn region. We publish booklet "Znay svoi prava" (Know
your rights).
For elderly people, disabled people and other people who are in prisons
and labor colonies of the region our clinic provides legal assistance
and distributes the booklet "Zany svoi prava" (Know your rights).
We provide consultations on family law, civil law, housing law, economical
law, criminal law, etc. The exception is when a person is accused of commiting
a crime and the case is in a preliminary investigation or in court.
We help with our consiltations, prepare documents (claims, complaints,
appeals), present our clients' interests in governmental institutions
and in court.
In case when solutionof a certain problem demands court hearing, we prepare
claims and all other kinds of documents for our clients and go to court
with them.
With clients' authorization our students lead cases in courts in correspondence
with civil-processual codex of Ukraine.
After the case is finished, the dossier about the case with information
about the leader of the program gets archived.
Since November 1999 till October 2001 276 citizens came to our clinic:
101 people between November 1999 and September 2000 , 175 people between
October 2000 and October 2001, out of them 71 people are imprisoned.
Such categories of people came to our clinic: pensioneers - 96 people,
imprisoned - 71 people, poor citizens - 62 people, youth - 10 people,
entrepreneurs - 6 people, disabled of the I category - 5 people, disabled
of the II category - 24 people, military disabled - 1 person.
Statisctics about spheres of law: civil law - 91 people, housing law -
40 people, social law - 24 people, family law - 19, labor law - 14 people,
land law - 9 people, civil-processual law - 8 people, economical law -
5 people, criminal and criminal-processual law - 42 people.
Over this mentioned period 158 legal documents were prepared, including:
59 inquiries to different organizations, 45 claims, 16 petitions, 22 appeals,
and 16 complaints.
Work of the clinic is organized on two levels: I level - work at the University
done by sophomore-senior students; II level - work at juridical firm "Vitalina"
The clinic is formed of sophomore-senior students who graduated special
course "Jurydychna praktyka" (Juridical practice). Thanks to
students' initiativeness this clinic works all the year round, including
holidays. There is a special schedule of work that is done by volunteers.
During holidays and vacations distant learning students get involved in
the work of the clinic. Their work at the clinic counts towards students
summer experience. On the individual basis it can be counted as pre-deploma
research if the student works at the clinic and executes his responsibilities.
From the beginning of clinic's existence 108 students graduated its course.
Next year 35 more students will graduate these courses. The special course
will be taught in October-December of this year.
Usually the clinic is responsible before the client for concrete court
cases, nevertheless, students are responsible, too. Our consulting faculty
are scientists, practicing lawyers, who teach at law schools and work
in courts, arbitrary courts, prosecutors' offices and other institutions.
Consulting faculty are involved into individual work with students who
prepare answers and legal documentation for civil claims. Consulting faculty
give their advices during preparation of concrete cases, give advices
about lawyer's ethics, legal aspects of all cases.
University pays faculty who teach special course "Juridical Practice"
and "Reformation of penitentiary system in Ukraine and adherence
to human rights at institutions of confinement" and who work individually
with students.
Director of the program, curator-faculty, student director, coordinator,
"Ad Astra" newspaper editor and editor of booklet "Know
your rights" get their salary from the grant money.
In the future when grant money is used we will have to solve the question
about paying for their job either from University funds, either from some
other sources.
Information about the work of clinic is distributed through newspaper
"Ad Astra" where we keep publishing advertisement for this clinic.
This newspaper is sent to law-enforcement bodies of the city and region,
regional state administration and regional Council, district councils,
institutes of social services and educational establishments of the city.
It is also distributed among students and among imprisoned people...
Besides this, social adverstisement for the work of this clinic is published
in regional press. We started programs for youth on Volyn telestation;
it this programs we tell about the work of our clinic. Regional department
of Justice cooperates with us and spreads information about this project.
Juridical clinic cooperates with (ÀÂÀ/ ÑÅÅLI), Informational-methodic
center "Debates", International Renaissance foundation and ÑÎLв
Besides this, juridical clinic cooperates with Volyn regional organization
of Ukrainian Bar Association and conducts joint projects; with private
juridical consultation firm "Vitalina" - using its normative
base and experience of work; with regional department of justice - preparing
projects of documents for non-governmental organizations that are in the
process of registration at Department of Justice; with law-enforcement
bodies and organs of self-government, with non-governemntal organizations
and charitable foundations when we give free consultations on legal issues.
